01
Scope
This Acceptable Use Policy applies to every message submitted to the TH platform and to every person who uses an account. It forms part of our Terms of Service. Where an operator or regulator imposes a stricter rule in a destination market, that stricter rule applies.
02
Consent
You may only message recipients who have given consent valid under the law of their country and under the rules of their mobile operator. Consent must be specific to the type of message you send: consent to receive a delivery notification is not consent to receive marketing.
You must keep records that show, for each recipient:
- when and how consent was captured, including the wording shown at the time;
- what categories of message the recipient agreed to receive;
- the identity of the business the recipient agreed to hear from.
Purchased, rented, scraped and appended lists are not a lawful basis for consent and may not be used on this network.
03
Identification and opt-out
Every promotional message must identify the sending business clearly and must offer a working opt-out. You must process opt-outs promptly and permanently, and you must not require a recipient to call, log in or pay in order to unsubscribe.
STOP, UNSUBSCRIBE, HELP and their recognised local equivalents must be honoured. Where the platform processes these keywords for you, you must not send further promotional traffic to a number that has opted out, regardless of the channel through which the opt-out was received.
04
Prohibited content
You may not send messages that promote, facilitate or contain:
- phishing, smishing, spoofing, malware, or links designed to deceive a recipient;
- fraud, pyramid or Ponzi schemes, fake job offers, or advance-fee solicitations;
- child sexual abuse material, or any content that sexually exploits a minor;
- threats, harassment, stalking, hate speech, or incitement to violence;
- unlicensed lending, high-risk investment or cryptocurrency solicitation;
- illegal drugs, controlled substances, or prescription medicines sold without licence;
- firearms, explosives, or other regulated weapons;
- content infringing another party's intellectual property or privacy rights.
Regulated categories such as gambling, adult content, tobacco, alcohol, cannabis, debt collection and political messaging are permitted only where the destination market allows them, only with prior written approval from us, and only with any licence the market requires.
05
Prohibited conduct
You may not:
- use a sender identity you are not entitled to use, or impersonate another business, person, bank or public authority;
- deliberately misdeclare a traffic class, for example submitting marketing content as authentication traffic to obtain priority routing;
- obscure content to evade operator filters, including through character substitution, deliberate misspelling, link cloaking or URL shorteners that hide the destination;
- send artificially inflated traffic, including SMS pumping or traffic generated to extract revenue share;
- distribute traffic across accounts, sender identities or providers to disguise volume or evade a suspension;
- probe, scan, overload or otherwise interfere with the platform, or attempt to access another customer's data;
- resell access to the platform without a written wholesale agreement with 3044 Pleasant LLC.
06
Market-specific rules
Some markets impose obligations beyond this policy, and you must meet them before traffic is enabled. Examples include DLT entity, header and template registration in India; brand and campaign registration through The Campaign Registry for 10DLC traffic in the United States; TDRA and CITC sender-identity approval in the United Arab Emirates and Saudi Arabia; brandname licensing in Vietnam; and NCC registration in Nigeria.
Quiet hours, do-not-disturb registries and national do-not-call lists apply in many markets. Where the platform enforces these windows, you must not attempt to bypass them.
07
Monitoring and enforcement
We monitor traffic patterns, complaint rates and operator feedback to protect route quality. Where traffic appears to breach this policy we may throttle it, filter it, suspend a sender identity, suspend an account, or terminate access, and we will notify you as soon as reasonably practical.
Serious breaches may be reported to operators, registries and regulators, and may expose you to fines levied by those parties. Under the Terms of Service you indemnify 3044 Pleasant LLC against such penalties.
08
Reporting abuse
If you have received a message you believe was sent in breach of this policy, or you are a recipient who cannot get an opt-out honoured, contact [email protected] with the sender identity, the receiving number, the message text and the time it arrived. We investigate every report and act on confirmed abuse. Requests from operators and regulators receive priority handling.
